Since its publication, the first part of this Copyright War – What do you think, who will win?- has left our readers excited about what will be covered in part 2, as it’s the topic that keeps us engaged throughout. So, here’s part 2 of AI and Copyright War – What do you think, who will Win?

The debate about genuineness is endless because, as I mentioned in part 1 under Writer’s Perspective, both have flaws; staying firmly with one is quite difficult, as the question of doubt regarding authenticity and copyright is largely directed towards Artificial Intelligence due to the prompts it creates. 

AI and Copyright War – In Legal Terms –

Not only in debates, but the AI and Copyright War is now being exaggerated into legal terms as well, as several legal issues are major concerns in this war of authenticity. From legal national/international authorities to guidelines, several aspects in terms of legal formalities are still major concerns for Artificial Intelligence. 

  • Controversial Authorship Challenges 

One of the most asked and genuine questions is – Who owns the Artificial Intelligence’s content? There’s no database of the earlier-written content, then who owns it? Is the content generated by AI owned by the prompter who gave the prompt for a particular topic or the machine that generated that content? There’s no law justifying the authorship, which made this a controversial topic and a huge challenge of authorship. 

  • Deefake or Face-Swapper Cases 
Concerns of Deep Fake Images arise.

While there are plenty of AI advantages, a big drawback of AI is this segment where you can morph an image or swap the face of any person with your desired body, which, for almost 98%, are used for explicit images and videos. Moreover, you can even mimic real people’s voices in your videos and audios, which, identically, is an identity theft followed by a parody too. Sometimes, it’s creativity for generating awareness.

Possible Outcomes of this Copyright War – 

Whether it’s a physical or a social war, each of them has two possible outcomes – Win or Lose, getting Recognition or Backlash, Acceptance or Rejected. On rare occasions, only, we can see that both parties agreed to align together, but, as I said, it’s rare. Let’s understand the possible outcomes of this Copyright War from both perspectives. 

  • What if the Courts come in favour of – Creator’s Side? 

If this happens, then that’s the complete win for the Creators as no more there content will be used without their permission, nor will it be mimicked and morphed. If this happens in reality, then Artificial Intelligence Companies will have to pay for the fees for using their content just like Spotify uses to pays musicians royalties for using their songs on their platforms. But again, everything comes with flaws and advantages. Even these have subtypes. 

  • Cons of having the Court in favour of the Creator’s side would result in restrictions on AI innovations, which, eventually, will raise the costs for using AI tools. That, in turn, would become a major concern for the startups as they can’t bear the high costs of the AI Tools, but large corporations would benefit from this con as they, for sure, would love to take advantage of these AI tools, even by buying them at such expensive rates.
  • Pros of having the Court and lawmakers in favour of the creator’s side would result in a complete Fair use of their contents with no copyright concerns. Which means, they no longer have to worry about the possible theft of content copyrights and will, in turn, generate them the necessary boost in traffic and strengthen the creator rights for being genuine. 
  • What if the Courts come in favour of – Artificial Intelligence Side? 

If the Court and Lawmakers came in favour of the Artificial Intelligence Side, then that would be a huge topic of discussion, as it would be a matter of concern for genuineness and copyrights. If such things happen, then there would be a strong uphold with AI tools and Artificial Intelligence Companies that will be using public data without any harsh restrictions, but in a rapid state without any permissions. Moreover, this not only provokes such AI Face Swapper stuff but would eventually be used for explicit content, mainly. 

  • The cons of having the Court in favour of Artificial Intelligence would eventually extend the usage of AI Tools in explicit and content-theft terms, which means privacy no longer will be in existence, and you can witness your voiceover and face without your permission, in any of the audios and videos. In addition, there would be a devastating effect on traditional creators and overall, as every creator and artist’s way of styling and presenting will be having an uphold with AI, as AI doesn’t copy but mimics the style and everything. Creative industries will no longer be considered worthy. Moreover, several jobs will be in danger.
  • The pros of having the Court in favour of Artificial Intelligence are limited to only two aspects: An impressive boost in fast innovation and in democratized creativity. There’s a limitation to the pros because the Cons of AI might will be having devastating effects. AI eventually would result in positive outcomes only by boosting innovations with its advancement.

Upholding anything, whether it’s Creators or the Artificial Intelligence, would eventually become an endless problematic debate for generations. When both parties agree to work together, it would eventually provide promising outputs instead of restricting one, as –

has no Boundaries of Creation.
